Abstract
O objetivo deste texto académico foi discorrer sobre em que medida os Processo Penais português e angolano preveem proibições de prova e nulidades processuais no âmbito das escutas telefónicas, numa vertente comparativa entre os dois Direitos. O itinerário de investigação para a compreensão e solução do problema, compeliu-nos a estudar, ainda que de formal superficial, a problemática da autonomia técnica e dogmática das proibições de prova em face do sistema geral das nulidades processuais no Direito português, como também, ensaiados critérios de distinção entre os dois regimes. O estudou mostrou que o conceito de nulidade previsto nas normas sobre escutas telefónicas, estabelece uma dupla ligação com as normas sobre proibições de prova e ao mesmo tempo com as nulidades gerais, termos em que a violação das normas de admissibilidade das escutas e as normas sobre as formalidades das suas operações reveste de diferentes consequências. O estudo ocupou-se ainda, sem profundidade, de analisar a conformidade das normas sobre escutas telefónicas do Código de Processo Penal Português (CPPP) com o sentido da jurisprudência do Tribunal Europeu dos Direitos Humanos (TEDH). Por fim, interessava averiguar se o Projeto do Novo Código de Processo Penal Angolano (PNCPPA) que consagra pela primeira vez proibições de prova e escutas telefónicas, resolve de forma cabal alguns dos problemas suscitados no CPPP, impondo-se uma conclusão de sentido negativo. - The aim of this academic text was that of discussing the extent to which the Portuguese and Angolan Criminal Procedures provide for the illegality of evidence and the procedural nullity in the scope of telephone tapping, within a comparative approach between the two Systems of Law. The research approach taken for the understanding and solution of the problem compelled us to analyse, even if superficially, the problematic of the technical and dogmatic autonomy of the inadmissibility of evidence regarding the general system of procedural nullities in the Portuguese Law, as well as the distinction criteria used between the two legal systems. The study has shown that the concept of nullity provided for in the rules for telephone tapping establishes a dual connection with the rules on illegality of evidence and at the same time with the rules of general nullities, in which the violation of the provisions for admissibility of telephone tapping and the provisions for the formalities of these operations have different consequences. The study also focused, although not in a comprehensive manner, on the conformity of telephone tapping rules provided for in the Portuguese Code of Criminal Procedure (CPPP) with the rulings of the European Court of Human Rights (TEDH). Finally, it was important to inquire into whether the Bill for the New Angolan Code of Criminal Procedure (PNCPPA), which provides for the first time on the illegality of evidence and telephone tapping, fully solves some of the problems raised in the Portuguese Code of Criminal Procedure (CPPP), for which the findings were negative. |
